What Calgary Real Estate Lawyers

Can Do For You

Many of us are acquainted with what a real estate agent can do on our behalf. They can find the perfect home you’ve been meaning to live in, or the ideal buyer for the one you want to move out of. But equally important to sealing the deal on a real estate transaction is a real estate lawyer.

A real estate lawyer protects your rights as a seller, and ensures that your duties are clearly defined. A real estate lawyer is essential to making sure that a real estate transaction is fair, that there are no hidden or unexpected liens on your property, and makes sure that you know and understand what you’re signing, whether it’s a contract or a sales agreement.

Having a real estate lawyer gives you a huge leg-up when it comes to negotiating a real estate transaction. If you’re selling a home, a real estate lawyer reviews and prepares your sales agreement, tipping the negotiations in your favor. They prepare the deed and power of attorney, if necessary. They attend the closing of the sale, to make sure that everything goes as planned, and they help secure title insurance if necessary. Some insurance agencies won’t accept an application for title insurance unless it has been drafted by a lawyer.

If you’re buying property, a lawyer checks the purchase contract, and ensure that you understand everything that’s in it. They also make sure that there are no liens or covenants that would impede your use of the property, and secure you a valid registered ownership of the property. If you’re getting a mortgage, a lawyer will help prepare and review the terms of your mortgage with the bank or lending institution that is providing it. In short, they ensure the success of your real estate transaction, and also ensure that you fully understand the terms of the sale, and are agreed to them.

While other agencies (such as real estate agents, or real estate consultants) do offer to prepare and review your legal documents for you, these people do not belong to a regulated profession, like lawyers do, and as such are not subject to the same standards that lawyers are. They are also uninsured, and in the event of an error you would have no recourse to remedy the situation.

Having a lawyer on your side means being able to understand and better control the terms of your real estate transaction. Legal documents are often difficult to understand on your own, and the last thing you want is to be surprised at the last minute by a clause or stipulation you would never agree to. A lawyer protects you from all of this. Having Calgary real estate lawyers on your side is truly a must when buying or selling property. If you’re unsure of where to find Calgary real estate lawyers, or which ones to trust, relax. We’ve found the bet Calgary real estate lawyers for you and are happy to share what we know.
